What Collected Deal is
Collected Deal is a tool for two parties who have agreed on a sale, and want to structure their transaction.
It does two things:
It asks the other party to complete ID verification through our provider
It generates a sales agreement for both of you to sign
That is the product. Everything below explains what that means and what it does not.
These terms sit on top of our Terms of Service. If anything on this page conflicts with the Terms of Service, this page controls for Collected Deal.
The fee
The fee is 3% of the transaction amount, capped at $499. Reduced rates apply to some account types.
It is charged when the other party completes ID verification and the sales agreement is signed.
The buyer pays the fee. A seller is never charged a Collected Deal fee.
When a buyer views a listing, Collected Deal is switched on by default. The buyer can turn it off before sending an offer, if they would rather not use it. If it is switched off, there is no ID verification and no sales agreement, no fee is charged, and the buyer and seller deal with each other directly.
We show you the amount before you are charged. Payment is handled by Stripe.
The fee is for the ID verification and the agreement, and it is earned when both are delivered. At that point our work is complete and the fee is not refundable, even if you and the other party never complete the sale. We tell you this at checkout, before you are charged.
If you think you were charged in error, email [email protected] within 30 days and we will look at it.
ID verification
ID verification is performed by our provider, currently Plaid.
During ID verification, Plaid may ask for a name, date of birth, address, phone number, a government-issued ID, and a photo. Plaid collects and processes that information directly, under Plaid's privacy policy and terms. Collected receives only the result of the ID verification. We do not receive or store ID images, photographs, or any biometric identifier.
What ID verification tells you. That a real person completed an identity check and that the details they gave match the documents they provided, as reported by our provider.
What it does not tell you. Whether that person is honest. Whether they have the money. Whether they have the watch. Whether they will ship it, pay for it, or describe it accurately. ID verification is an identity check and nothing more.
We may change providers. If we do, this page will say who.
The sales agreement
Collected generates the sales agreement from a standard form, using the information you and the other party provide. Both parties sign it electronically and both receive a copy in their Vault.
Collected is not a law firm and does not provide legal advice. We do not represent you or the other party, and we make no representation that the agreement is enforceable in your jurisdiction. If the amount is significant to you, have your own attorney review it before signing.
The information in the agreement comes from you and the other party. We do not verify the watch, the serial number, the condition, or that the seller owns it.
Signing electronically
By using Collected Deal, you agree to do business electronically and to sign the sales agreement with an electronic signature, which has the same effect as a handwritten one.
To do this you need a device with a current web browser or the Collected app, an internet connection, and an email address that can receive our messages. You should be able to save or print PDF files.
You can withdraw your consent to transact electronically at any time by emailing [email protected], but doing so means you cannot use Collected Deal. You can request a paper copy of any agreement you have signed by emailing the same address.
What Collected Deal is not
Collected is not a party to your sale. The agreement is between you and the other party, whether that is an individual or a business.
We do not hold the item. We never take possession of it, at any point.
We do not hold the money. This is not escrow. We do not receive, hold, transmit, or release the purchase price. You pay each other directly, by whatever method you agree on.
We do not authenticate or inspect anything. We do not examine the item, appraise it, or confirm that it is genuine or that it matches its description.
We do not guarantee the transaction. If the other party does not pay, does not ship, or ships something different from what they described, that is a dispute between the two of you. We offer no buyer protection, no seller protection, no insurance, no refund, and no guarantee of any kind on the underlying sale.
We do not verify ownership or title. We do not know whether the seller owns the item, or whether it is free of any lien or claim.
If something goes wrong with a transaction, you may need to involve your own bank, your own insurer, your own attorney, or law enforcement. Tell us at [email protected] as well, because it helps us act on the accounts involved, but we cannot resolve it for you.
What you may not use it for
You may not use Collected Deal for a transaction that is unlawful where either party is located, for goods that cannot lawfully be sold, transferred, or shipped, or for any transaction involving a person or entity subject to sanctions. You are responsible for knowing whether your transaction is lawful.
Taxes
You are responsible for any tax arising from your transaction, including sales, use, import, and income tax. Collected does not collect or remit tax on your sale and does not report your transactions to any tax authority on your behalf.
We may add sales or similar tax to our own fee where the law requires it.
Suspension
We may refuse or cancel a Deal, and suspend the accounts involved, where we reasonably believe there is fraud, a sanctions issue, counterfeit goods, or a breach of our terms. Where we cancel before ID verification and signature are complete, we will not charge the fee, or we will refund it if it has already been taken.
Liability
The disclaimers, liability limits, and dispute provisions in our Terms of Service apply to Collected Deal.
