Collected Solutions Inc. ("Collected") respects other people's intellectual property, and we expect the people who use Collected to do the same. This policy forms part of our Terms of Service.
We will disable or close the accounts of people who repeatedly infringe.
Where the content on Collected comes from
This matters for knowing who to contact, so we will be specific.
Content uploaded by users. Photographs, descriptions, and profile content uploaded by the person who posted it. That person is responsible for having the right to post it.
Listings we publish for a seller. For sellers on our Dealer tier, we create listings from that seller's own public website, at that seller's request and with their permission. The seller confirms to us that they own the photographs and descriptions or have the right to license them.
If a listing on Collected uses a photograph or description you believe is yours, the seller named on that listing supplied it, and we will act on a notice about it the same way we would for anything else. Send us a notice and we will take it down.
If you are a seller and something on your Collected listings is not yours to license, tell us at [email protected] and we will remove it.
Our own content. The Collected name, logo, software, interface, and the design and organization of the Service belong to us.
Reporting copyright infringement
Under the Digital Millennium Copyright Act, if you own a copyright, or are authorized to act for someone who does, you can report infringing material on Collected by sending a notice to our designated agent below.
Your notice must include all of the following:
Your full legal name and your physical or electronic signature
Identification of the copyrighted work you say has been infringed, or a representative list if there are several
Identification of the material you say is infringing, with enough detail for us to find it, including the URL where possible
Your mailing address, telephone number, and email address
This statement: "I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law."
This statement: "The information in this notice is accurate, and under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right that is allegedly infringed."
Send it to the designated agent below. We will review it and take whatever action we think is appropriate, which usually means removing the material and telling the person who posted it.
Reporting trademark infringement
If you believe a trademark of yours is being used on Collected in a way that infringes, send our designated agent a notice including:
Your full legal name and your physical or electronic signature
Your contact details, including a mailing address, telephone number, and email address
Identification of the mark, with a copy of the registration certificate for a registered mark, or evidence of your rights for an unregistered one, including how, where, and for how long you have used it
Enough information for us to identify the use you are challenging
This statement: "I have not authorized the challenged use, and I have a good-faith belief that the challenged use is not authorized by law."
This statement: "Under penalty of perjury, all of the information in this notification is accurate, and I am the owner of the mark, or authorized to act on behalf of the owner."
Note that sellers on Collected are permitted to use brand names to describe the watches they are selling, because that is how a marketplace works. A notice about accurate descriptive use of a brand name is unlikely to succeed.
Reporting other intellectual property infringement
For patents, design rights, and other intellectual property, send our designated agent a notice including your name and signature, your contact details, a description of the right and evidence that you own it in the relevant jurisdiction, enough information for us to identify the use you are challenging, and the same two statements as the trademark section above.
Counter notification
If your material was removed and you believe that was a mistake, you can send our designated agent a counter notification including:
Your physical or electronic signature
Identification of the material that was removed and where it appeared before removal
Your name, postal address, telephone number, and email address
A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
A statement that you consent to the jurisdiction of the federal district court for the district where you live, or, if you are outside the United States, any judicial district where Collected may be found, and that you will accept service from the person who sent the original notice
Repeat infringers
We keep track of notices. An account that is the subject of repeated valid notices will be suspended or closed.
